LEGAL SERVICES RETAINER AGREEMENT (“the Agreement”) between (“you”) (required) (required) and MARLON SHEVELEW AND ASSOCIATES INC(“MSA”) TERMS OF THE AGREEMENT 1. The Agreement, once signed by you and MSA, provides for 2 (two) hours a month of Residential/Commercial Rental Property Law advice from MSA for a 6(six) month period. (“the Services”) 2. The cost is R350.00 plus Vat (R399.00) per month which is due on the 1st day of each month, in advance. 3. Any hours not used will not be carried over to the following month. 4. All Residential/Commercial Rental Property Law advice we attend to after your hours have been used in any particular month will be billed at our reduced rate of R1000 plus Vat (R1140), per hour. We will notify you if your monthly hours are close to being used up in any particular month and will not exceed your monthly hours unless you allow us to. 5. Any non-payment for a particular month will be a breach of this Agreement and will entitle MSA to charge its normal charge out rate for that particular month for advices rendered or any other work undertaken in terms of this Agreement. PROFESSIONAL SERVICES 6. Any non-rental law related matters, drafting of letters, documents, evictions and rent collections are excluded. These will be charged at discounted MSA rates. MSA will competently represent your interests at all times. If you believe that this is not being done by us, please discuss it with Marlon Shevelew. In accordance with the Rules of Professional Conduct, we may decide to stop acting for you if we have good reason and on giving you reasonable notice. CANCELLATION 7. To cancel the Services at any time during the Agreement MSA requires at least 20 (twenty) business days written notice of such cancellation. The penalty due to us will be a 1 (one) month cancellation fee. If the Agreement is not cancelled and the period of 6 (six) months ends, the Agreement will automatically continue on a month-to-month basis which can be terminated by either you or MSA without any penalty on a calendar months’ notice. GENERAL 8. You agree that we make no guarantee regarding the outcome or success with regard to any matter. Our advice is based on our understanding of the law and practice as at the time it is given. It may be affected by subsequent changes in law and practice. We have no legal obligation to update advice once given and we do not undertake to do so unless specifically agreed. 9. The Agreement contains the entire agreement between us for each service and may be amended in writing and signed by both you and MSA. 10. The Laws of the Republic of South Africa govern this Agreement and if there is any dispute between you and MSA, such dispute may be resolved by binding ar- bitration, provided that both parties consent to such arbitration at the time the dispute arises. Prior to arbitration, such matter shall be mediated by a third party chosen jointly. CONSUMER PROTECTION ACT 68 OF 2008 (“CPA”) 11. You confirm that by your signature of this Agreement, you have read and understand the Agreement; all necessary clauses have been explained to you by MSA, you have been advised of all your rights in terms of the Agreement and all relevant sections of the CPA, and you sign the Agreement freely and voluntarily.
